China Ratifies the Accord between the People's Republic of China and the Islamic Republic of Pakistan on Criminal Judicial Assistance

It was decided by voting at the fourth session of the Standing Committee of the 11th National People’s Congress on August 29 2008 that the Accord between the People's Republic of China and the Islamic Republic of Pakistan on Criminal Judicial Assistance was ratified.

While testifying to the fourth session of the Standing Committee of the 11th National People’s Congress, Vice Foreign Minister He Yafei said that as the political, economic and trade relations between China and Pakistan move forward, the two countries also started to carry out judicial cooperation. On November 3, 2003, the two countries signed the Extradition Treaty between the People's Republic of China and the Islamic Republic of Pakistan, which was ratified by the 18th session of the Standing Committee of the 10th National People’s Congress in October 2005. To further strengthen judicial cooperation between the two countries and combat transnational crimes, the two countries deemed it necessary to enter into an accord on criminal judicial assistance. In April 2007, Li Zhaoxing, then Chinese Foreign Minister and Syed Sharifuddin Pirzada, Senior Advisor to the Prime Minister on Foreign Affairs, Law, Justice & Human Rights signed the Accord between China and Pakistan on Criminal Judicial Assistance on behalf of their countries.

The Accord between China and Pakistan on Criminal Judicial Assistance contains 26 articles, mainly covering the scope of application, reasons for refusing or deferring judicial assistance, contents of the request for judicial assistance, ways and rules for executing the request, exchange of legal documents, dispute settlement, and the procedures of entry into force, revision and termination of the accord.
