Speech at "Export Control Day"

Ladies and Gentlemen:

I'm very glad to take part in this "Export Control Day" held in Muenster, Germany. First of all, I would like to extend my gratitude to the German Federal Office on Economics and Export Control (BAFA) for the invitation. According to my knowledge, this is the largest interactive activity between government agencies and enterprises ever held in Germany. This year, it is also expanded into an international conference by inviting US and Chinese representatives. I believe that activity as such will provide an excellent platform for inter-reactions, policy exchanges and experiences-sharing between governments and enterprises on topics of export control.

Proliferation of WMD and their means of delivery are currently a prominent issue in international politics and security. On the one hand, nations have attached greater importance to non-proliferation. Consensus has been deepened and cooperation has been expanded in this regard. On the other hand, some regional hot issues regarding non-proliferation remain hard to tackle. With economic globalization, scientific and technological developments, it is more difficult to prevent proliferation of sensitive items and techniques. Meanwhile, we must not ignore the risk that some non-governmental actors, especially terrorists might illegally acquire, transport and sell certain WMD-related materials.

The Chinese Government has consistently advocated complete prohibition and thorough destruction of WMD, and has been firmly against the proliferation of WMD and their means of delivery. It has constantly dealt with non-proliferation issues with a responsible and constructive approach, and has made unremitting efforts to advance the international non-proliferation process safeguard and promote international and regional peace and security.

From Chinese perspective, in order to prevent WMD proliferation, efforts should be made in the following four areas effectively:

1. Strive to establish a global and regional security environment based on mutual trust and cooperation, so as to eliminate the motivations of proliferation;

2. Address the issues of non-proliferation through political and diplomatic measures;

3. Maintain and enhance the authority, effectiveness and universality of the international non-proliferation mechanisms;

4. Ensure the just and non-discriminatory nature of the international non-proliferation efforts and strike proper balance between non-proliferation and peaceful use of science and technology.

The Chinese Government has strictly fulfilled its international non-proliferation obligations, Constantly strengthening its legal system ensuring non-proliferation and effectively implemented the non-proliferation policies. From mid 90s of the last century to the beginning of the 21 century, China drafted and enacted a series of laws and regulations on export control and has since been improving them continuously in accordance with the developing situation. China has established a comprehensive export control system which covers nuclear, biological, chemical and missile-related duel-use items and technologies as well as conventional arms. Relevant export control laws and regulations are in line with international common norms and practices. Various measures have been adopted, namely: license system, end-user and end-user certificate, inventory controlling methods, systems of approval and comprehensive control for the purpose of non-proliferation. All these laws and regulations include clearly specific punishments for relevant illegal export activities. The inventory for export control adopted by the Chinese Government now is basically consistent with the lists of multilateral export control mechanisms like the Nuclear Suppliers Group, the Australia Group and the Missile Technology Control Regime.

The Chinese Government has strictly implemented the laws and regulations concerning export control for non-proliferation. It has also made great efforts in establishing mechanisms, promoting policies and regulations and educating the enterprises, thus providing effective system guarantee for export control. Authorities like the Ministry of Commerce and General Administration of Customs in China have taken active measures, such as holding training sessions, seminars and online office annually. Through these measures, the training for officials in charge at all levels has been enhanced. Meanwhile, they have also been introducing export control laws and regulations and relevant UN Security Council Resolutions to export related enterprises, so that the legal, law-abiding and self discipline awareness of the manufactures, exporting companies and forwarding agents has been strengthened.

While improving and perfecting the export control legal system, the Chinese Government has always adhered to the principle that the law must be observed and strictly enforced and the law-breakers must be punished. We have established a cross-sector emergency mechanism to tackle proliferation cases quickly and effectively. The Chinese Government has also been strengthening the law enforcement team so as to promote the efficiency and quality of law enforcement.

Mr. President,

Non-Proliferation requires the universal participation and joint effort of the international community. China is always committed to the exchanges and cooperation in non-proliferation and export control. China has joined all non-proliferation international conventions and some of the multilateral export control regimes. China supports Resolution 1540 and its committee of the UN Security Council. China has seriously implemented relevant Security Council resolutions. Bilaterally, China has carried out exchanges on export control and established arms control and non-proliferation consultation mechanisms with many countries. China attaches importance to multinational export control mechanisms and has maintained dialogues and exchanges with the Wassenaar Arrangement, the Australia Group and the Missile Technology Control Regime.

Among various exchanges on non-proliferation and export control between China and its counterparts, the cooperation between China and EU could be regarded as a very successful role model. In 2004, China and EU issued the "Joint Declaration on Non-proliferation and Arms Control", recognizing each other as strategic partners in the field of non-proliferation and identifying export control as a priority for cooperation. Over the last 6 years, China and EU have, on the basis of equality, cooperation and mutual benefit, steadily promoted the exchanges and cooperation, as a result, our consensus on issues of non-proliferation has been expanded and export control exchanges deepened. Through these efforts, we have not only further enriched and the content of China-EU Strategic Partnership, bus also made great contributions to international non-proliferation cooperation.

The success of China-EU cooperation in non-proliferation and export control can not be achieved without the unremitting efforts of BAFA as the executive institution. The "Export Control Day" is another demonstration of BABF's key role in the field of export control.

Mr. President,

The non-proliferation and export control is a long-term and arduous task that needs continuous efforts of all the nations. China and Germany share a lot of common views and concerns in the non-proliferation field, which constitute a broad and solid foundation for our further cooperation. Together with other nations, China is willing to further improve its legal system, enhance the capacities of law enforcement, promote international cooperation and exchanges and make our due contribution towards international non-proliferation efforts.
