《中华人民共和国外交部礼宾司关于外国驻华外交代表机构携带枪支入出境的照会》及《各国驻华外交代表机构及其人员持有枪支备案登记表》

各国驻华大使馆、各国际组织驻华代表机构:

  中华人民共和国外交部礼宾司向各国驻华大使馆、各国际组织驻华代表机构致意,并谨就外国驻华外交代表机构携带枪支入境、出境的实施办法通知如下:

  一、《中华人民共和国枪支管理法》已由中华人民共和国全国人民代表大会常务委员会于一九九六年七月五日通过并予公布,于一九九六年十月一日起正式实施。

  二、各国驻华大使馆、各国际组织驻华代表机构和领事机构及人员携带枪支入境,须提前15天照会中华人民共和国外交部提出申请(一式两份,下同),凭经外交部同意的复照到入境边防检查站核实枪号,领取携运枪支许可证,海关凭携运许可证放行。入境后15天后持外交部照会和枪支携运证到当地市公安局办理备案登记手续,填写《各国驻华外交代表机构及其人员持有枪支备案登记表》,一式两份,自留一份。

  三、各国驻华大使馆、各国际组织驻华代表机构和领事机构及其人员携带枪支出境,应提前5天照会外交部。凭外交部复照和公安局备案登记表到公安局开具枪支出境证。出境地海关、边防检查站凭枪支出境证验核放行。

  四、各国驻华大使馆、各国际组织驻华代表机构和领事机构及人员已经携带的现有枪支,请有关馆于一九九六年十一月一日前到当地市公安局重新办理备案登记手续。

  五、依照上述规定携带入境的枪支,不得携出所在的驻华外交机构。北京市公安局的承办单位是“外国人管理出入境管理处”,联系电话:65255982。

  六、本办法自发照之日起实行。一九八一年十一月起实行的《关于各国驻华外交代表机关枪支、弹药的管理办法》同时废止。

NOTE OF THE PROTOCOL DEPARTMENT OF THE MINISTRY OF FOREIGN AFFAIRS OF THE People's REPUBLIC OFCHINA ON THE ENTRY AND EXIT OF FIREARMS BY DIPLOMATIC MISSIONS IN CHINA

  The Protocol Department of the Ministry of Foreign Affairs of the People's Republic of China presents its compliments to the Diplomatic Missions and Representative Offices of International Organizations in China and, with reference to the firearms brought in and out of China by Foreign Embassies or Representative Offices, has the honor to notify the latter that:

  Ⅰ. The law of the People's Republic of China on Control of Guns was adopted and promulgated by the Standing Committee of the National People's Congress of the People's Republic of China on 5 July 1996 and put into effect on 1 October 1996.

  Ⅱ. Embassies, Consular Posts or Representative Offices of International Organizations in China, and their staff who wish to bring firearms into China shall file an application to the Ministry of Foreign Affairs of the People's Republic of China in the form of Note (in duplicate) 15 days in advance for permission to do so. They must go through the relevant formalities with the border check-points concerned for a permit to bring in the firearms with a positive Reply Note from the Ministry of Foreign Affairs and the serial number of the firearms checked by the checkpoints. The customs may allow the firearms in with an entry permit.The holder of the firearms must go through the registration procedure with a local municipal public security bureau within 15 days of their entry with the Note from the Ministry of Foreign Affiairs and the entry permit and fill in a Registration Form of Firearms Possessed by Diplomatic Missions in China and Their Staff in duplicate copies with one retained for the registrant.

  Ⅲ. Those Embassies, Consular Posts or Representative Offices of International Organizations in China, and their staff who wish to bring firearms out of China shall file an application to the Ministry of Foreign Affiairs in the form of a Note 5 days in advance and shall obtain a permit for bringing out the firearms from a public security bureau with a Reply Note of the Ministry of Foreign Affairs and the Registration Form.The customs and the border check-point will permit such firearms out of China only if there is an exit permit issued by the public security bureau.

  Ⅳ.Embassies, Consular Posts and Representative Offices of International Organizations and their staff in China shall re-register firearms already brought into China with local municipal public security bureaus by 1 November 1996.

  Ⅴ. Firearms brought into China by Diplomatic Missions after going through the above-mentioned procedures are not allowed out of their respective chanceries. The Division of Aliens and Entry Administration of Beijing Municipal Public Security Bureau (Tel.65255982) shall be in charge of this matter.

  Ⅵ. The regulation takes effect on the date of this Note while the Regulations Concerning the Control of Firearms and Ammunitions in the Possession of Diplomatic Missions in China that took effect in November 1981 is automatically nullified.

  The Protocol Department of the Ministry of Foreign Affairs avails itself of this opportunity to renew to the Diplomatic Missions and Representative Offices of Intermational Organizations in China the assurances of its high consideration.
